Examiner’s commentary

This is a thorough account of a range of functionalist studies. There is sophisticated understanding of the material presented.

Analysis is clear and the material is well explained using appropriate concepts. This conceptual detail in some evaluation is shown, although this is limited to internal evaluation between the various functionalist perspectives.

Other perspectives are only briefly mentioned in the final paragraph. This could be developed further to show a clear debate between perspectives. The answer shows application of material from the item and also from the student’s knowledge. This is accurately applied to the question.

The final concluding paragraph could be more developed. The brief points on Marxism and feminism could be developed throughout the answer rather then simply stated at the end.

Analysis is explicit and relevant.

One advantage is that participants are aware you are researching them and so you’re able to write down notes about what you are observing and record it. However, with covert PO you are unable to do so because it would be suspicious, especially if you are observing dangerous ways of life. For example, Venkatesh’s required covert PO as he was unable to write down all the information and relied on retrospective data – from his memory. This means the data could lack validity because he could have forgotten less important aspects from the observation. This issue doesn’t arise with overt observation and so the data is more likely to be valid. 

Overt PO is more objective and can be ethical. The participants are aware that the data is for a study and publication and they are less likely to withdraw. Whereas with covert PO, informed consent has not been collected and participants, after realising they have been deceived may choose to withdraw and not allow the researchers to use the data collected. This means that the data from covert PO may go unpublished and the researcher may have to reconduct another research method, wasting time and energy.

Interpretivism is the view that sociology is not a science. Interpretivists argue that, because humans think and reflect, scientific methods are inappropriate as they do not allow us to truly understand and dig beneath the surface of behaviours and actions. Unlike objects, which can be analysed using scientific methods, Interpretivists argue that human beings change their behaviour if they know they are being observed, called the Hawthorne Effect, therefore if we want to understand social action, we have to delve into meanings using qualitative, unscientific methods. Interpretivists are subjective, meaning science is not appropriate for sociology in their opinion as it gives objective results and data. Interpretivists argue that the purpose of sociology is to understand human behaviour, no quantify it using scientific methods, therefore it cannot possibly be a science.

Kuhn stated that science is paradigmatic, meaning there is a fixed set of rules and principles which science uses. It is like a set of norms and values and is accepted by all scientists. Therefore, according to Kuhn, sociology is pre-paradigmatic and hasn’t reached the stage where there is a general paradigm shared by most social scientists. This is seen by the fact that sociology has a range of views and theoretical perspectives and there is no agreed set of norms and values. Feminists will always disagree with functionalists. Sociological perspectives may also have internal disagreements such as Merton’s criticism of other functionalists. Those who criticise Kuhn, however, would question whether science itself has a paradigm. Many sciences exist with different sets of paradigms such as psychology

Students typically find this topic one of the most difficult, and most answers will come NO WHERE NEAR this standard.

Technically, I don’t think the last sentence should get any marks, because it is not focused on the actual question.

Contemporary Sociology: The Parsons Green Tube Bomber

The Tube Bomber: A “Duty” to Hate Britain?

The case of Ahmed Hassan, the 18 year old Iraqi asylum seeker who planted a homemade bomb onto a London tube train in September 2017, injuring 51 people is a good candidate for the most serious crime of 2017. Had his device worked properly (it ‘only’ created a fireball rather than actually exploding) dozens of people would have died.

Hassan was sentenced to life in March 2018, and ordered to serve a minimum of 34 years.

Hassan claimed that he never wanted to kill anyone, he said he was depressed and seeking attention and thrills, having watched Mission Impossible films and developed the fantasy of being a fugitive pursued by Interpol across Europe.

However, there was also the fact that he seemed to have harboured intense loathing of the UK, which he blamed for his death in an explosion in Iraq a decade ago. When he arrived in the UK in 2015 (illegally in the back of a lorry) he told immigration officials that he’d been seized by Islamic State and ‘trained to kill’ (although he claimed to have made this up in court); and he had previously been seen watching extremist videos and apparently sending money to Isis. He’d also told one of his teachers that he had a ‘duty to hate Britain’.

What’s interesting about this case, is how all of the ‘standard’ preventive measures just failed to work….he had been given a foster couple who ‘showered him with love’ and was getting on well with his education – in fact, he seemed to be flourishing, having been made student of the year in 2017 in his college in Surrey: although he actually used his £20 Amazon voucher prize to buy chemicals for his bomb, which he then packed with knives, screwdrivers and nails.

Hassan had also been referred to the ‘Prevent’ deradicalisation programme, but this clearly didn’t work, and social services didn’t even warn his foster parents about his extremist leanings.

Relevance to A-level sociology…

At first glance, this seems to be a good case study which illustrates the necessity the take a stronger line on illegal immigration…if someone can commit a crime of this magnitude with all of the Preventative measure we already have in place, surely it’s impossible to prevent something like this happening again? Maybe a tougher line on immigration would have prevented this?

However, what we’re not seeing with just one dramatic case study is the bigger picture – all of the other cases that the authorities are preventing with their various crime control techniques… and let’s not forget that in complex risk society it is practically impossible to eradicate all ‘bad things’ from happening, so perhaps we just have to need to learn to live with this without panicking unduly.

This could also possibly show us the failings of ‘categorical suspicion’ as a means of crime control – possibly the fact that Hassan had ‘good foster parents’ and he was doing well at college were enough for the authorities to disregard all the other warning signs?

My attempt at a model 10/10 answer for this A-level sociology exam question (crime and deviance topic)

This is the 10 mark question in the crime and deviance section of the AQA’s 2015 Specimen A-level sociology paper 3: Crime and Deviance with Theory and Methods.

I used this question as part of our department’s own paper 3 mock exam this year (February 2018).

In this post I consider a ‘lower middle mark band’ student response (4/10 marks) to this question and the examiner commentary (both are provided by the AQA here) before considering what a ‘top band’ answer might look like.

A top band answer?

The first problem with situational crime prevention techniques such as installing burglar alarms is that they mail fail to increase the risk of getting caught in the subjective opinion of the burglars.

Many criminals are indeed rational and thus may reason that burglar alarms are ineffective – most members of the general public ignore them after all, and some may even be ‘fake’. There is also the fact that the police may take a long time to respond to an alarm, thus if criminals can act quickly enough, they may ‘calculate’ that they can get away with a smash and grab type robbery before the police respond, thus reducing the likelihood of getting caught.

A more effective form of situational crime prevention, other than a burglar alarm, might be a security guard, which would increase the risk of getting caught significantly as they can simply phone the police if there is any suspicious behaviour nearby.

However, security guards are expensive compared to alarms, and so while those places which hire security guards may be protected, crime will just be displaced to those areas with lesser protection (like ineffective alarms or no alarms’.

Finally, if we apply Felson’s ‘Routine Activity Theory’, we know that criminals ‘size up’ their targets when going about their day to day business, so they know the areas which are the least effectively protected and the least risky…. thus target hardening strategies like those mentioned in item are only going to be effective if all properties. use them equally, which is unlikely.

A second problem with Situational Crime Prevention talked about in item A is that not all crime is a rational decision, some crimes are done on the ‘spur of the moment’, for the ‘thrill of the act’, or out of sheer desperation.

Situational Crime Prevention failed, for example, to prevent the London Riots happening – here many of the rioters engaged in looting and vandalism in order to ‘have fun and join in with the party atmosphere’ despite the fact that all of the properties looted were locked and under surveillance, and there being thousands of police on the streets.

The Riots were also fueled by a sense of injustice at police brutality and economic inequality, which suggests that inequality in society ultimately fuels crime, which can spill-over at flash points, no matter how much one ‘hardens targets’: and target hardening does nothing to address the underlying causes of crime such as injustice and inequality.

Another example of a crime which is not rational is football hooliganism – which increasingly just seems to be about ‘fun’ – ‘teams’ of hooligans arrange fights after the match for thrills, and it is difficult to see how situational crime prevention can reduce this, as it’s just about ‘fun’ rather than ‘reward’ in the eyes of those involved.

 

Russell Brand’s Wedding Present for Harry and Meghan

A Windsor counsellor recently suggested that the homeless of Windsor should be cleared off the streets in time for Harry and Meghan’s wedding.

One person (probably among many others) that’s not happy about this is Russell Brand, who pointed out that yet again it’s the marginalised and powerless who are being made to suffer so that the elite can have a ‘jolly nice time’.

He outlines his views in this brief, 5 minute video clip:

One of this suggestions is that Slough Council should hand over one its buildings to SHOC ‘Slough Homeless Our Concern’, so at least there is some real, tangible, extra support being made available for the homeless in the area.

Relevance to A level sociology

I thought this was a cheeky little example to highlight how the marginalised get treated in this country, also illustrates elements of the social construction of crime – in that ‘homelessness’ becomes more of a problem when the context (the impending wedding) approaches.

Also – here we have celebrity Russell Brand, a ‘moral entrepreneur’ spearheading a very specific, niche, social policy campaign (/suggested intervention) via his YouTube channel – there’s something very postmodern about all of this…

The Church of Stop Shopping – A Sociological Analysis

Reverend Billy and The church of stop shopping are critical of our addiction to shopping – especially at Christmas. They suggest we are facing a ‘Shopocalypse’ – arguing that over consumption fuels the debt crisis, global warming and destroys local economies and communities if products are purchased from TNCs.

Instead, they suggest that we should use Christmas as a time to develop positive new low-consumption habits – learning to be happy with less! The video below – ‘What Would Jesus Buy’ is an excellent documentary outlining their ‘activist performance art’ and their general critique of consumption at Christmas.

The Church uses its performance art to protest more widely than just at Christmas – they target unethical companies, such as banks who fund logging in the Rain Forest, and target their lobbies to protest their involvement, and get arrested a lot in the process!

There’s all sorts of links with the A level Sociology syllabus:

  • Linking to sociological theories… the Church is coming from a broadly leftist, Marxist perspective in its criticisms of our consumption habits.
  • Linking to Crime and Deviance – obviously what they are doing is deviant! More interestingly, it’s interested to note how their dealt with by the state – during many of their protests, they get arrested, spend a night in jail, then they’re back out again… while the far more harmful practices of the Corporations they protest against just carry on.
  • These activists are protesting what they see as ‘Green Crimes’ – companies which harm the planet, but of course these acts are not defined as such by the state.
  • Linking to Methods – you could argue that what they are doing is a form of ‘ethnomethodology?’ (look it up, it’s not a core part of the A-level syllabus!)
  • Linking to the Family – Personal Life Perspective maybe?
  • Linking to Education – well it’s educational!
  • And linking to religion – I dunno, I’m a bit confused about this! Possibly nothing at all?

Meet the Natives (Sociology on T.V.)

Meet the Natives involves five people from a tropical island visiting a ‘strange land called England’, where they find many of the customs unusual.

At various points throughout the video the ‘natives’ from Oceania have problems understanding British dinner rituals, the food we eat, housework/ the amount of stuff we have and even the concept of wearing clothes.

Videos like this are a great way to introduce the ‘sociological imagination’ to students, because they are shot from the perspective of ‘the outsider’ and remind us that many of our taken for granted activities are actually quite unusual….

Sociological Perspectives on the London Riots

What were the main causes of the 2011 London riots? What sociological perspectives does the evidence support?

The London Riots of August 2011 are a good way of introducing ‘perspectives’ on crime and deviance, as well as the strengths and limitations of studying crime using different methods.

The 2011 London Riots – Background/ Context

Between 6 and 10 August 2011, several London boroughs and other cities and towns across England suffered widespread rioting, looting and arson.

The first night of rioting took place on 7 August 2011 after a peaceful protest in Tottenham, following the death of Mark Duggan, a local man from the area, who was shot dead by police on 4 August 2011. Police failed to notify Duggan’s family of his death and no senior police officer was available to meet the protest, creating anger at perceived disrespect. The protesting crowd outside the police station set light to two police cars, and the pictures of this circulated on social media attracted other people to the area – what started as a relatively peaceful protest quickly descended into a riot involving mass looting.

The following days saw similar scenes in other parts of London with the worst violence taking place in , Brixton, Chingford, Peckham, Enfield, Croydon, Ealing and East Ham. The city centre in Oxford Circus was also attacked. From 8 until 10 August, other cities in England including Bristol, Manchester, Birmingham and Liverpool, along with several towns, saw what was described by the media as ‘copycat violence’.

The riots were characterised by rampant looting and arson attacks of unprecedented levels. As a result, David Cameron returned early from his holiday in Italy and other government leaders also ended their holidays to attend to the matter. All police leave was cancelled and Parliament was recalled on 11 August to debate the situation.

There were a total 3,443 crimes across London linked to the disorder, including 5 deaths and at least 16 others injured as a direct result of related violent acts. An estimated £200 million worth of property damage was incurred, and local economic activity was significantly compromised.

The riots have generated significant on-going debate among political, social and academic figures about the causes and context in which they happened.

Biased Media Reporting on the London Riots

This Daily Mail article on the London riots by Melanie Phillips on is a superb example of  a New Right take on the ’causes’ of the event…extracts below…..

‘ The violent anarchy that has taken hold of British cities is the all-too-predictable outcome of a three-decade liberal experiment which tore up virtually every basic social value. What is so notable and distressing is that this mayhem has been carried out in the main by teenagers and children, some as young as eight. These youths feel absolutely entitled to go ‘on the rob’ and steal whatever they want.’

‘What has been fuelling all this is not poverty… what we have been experiencing is a complete breakdown of civilized behavior among children and young people… We are not merely up against feral children, but feral parents… either they are too drunk or drugged or otherwise out of it to care, or else they are helping themselves to the proceeds, too.’

‘As David Cameron observed yesterday, there are clearly pockets of society that are not just broken, but sick. Most of these children come from lone-mother households. And the single most crucial factor behind all this mayhem is the willed removal of the most important thing that socialises children and turns them from feral savages into civilised citizens: a father who is a fully committed member of the family unit. The result is fatherless boys who are consumed by an existential rage and desperate emotional need, and who take out the damage done to them by lashing out from infancy at everyone around them. Such children inhabit what is effectively a different world from the rest of society. It’s a world without any boundaries or rules. A world of emotional and physical chaos.’

‘This breaking of the family was encouraged by the Welfare State… Welfare dependency further created the entitlement culture that the looters so egregiously display. It taught them that the world owed them a living. It taught them that their actions had no consequences.’

Actual evidence on the ’causes’ of the London Riots’

Melanie Philips no doubt enjoys writing for the right wing daily mail, and her readers no doubt enjoy the sense of righteous moral indignation they feel when reading her articles (they are all in pretty much the same vein!). Unfortunately for them, but more unfortunately the impoverished teenage children of the single parents she lambasts, this is an extremely narrow analysis of the causes of the Riots. Moreover, Philip’s analysis is not supported by the rigorous quantitative and qualitative research carried out by the London School of Economics in the year since the riots. This is not to say that irresponsible parenting and the breakdown of social control didn’t have something to do with the riots – but there are a lot of other factors that need to be considered as well.

The findings below are based on the research findings taken from Reading the Riots Researchers spoke to 270 rioters: 185 people in London, 30 in Birmingham, 29 in Manchester, 16 in Liverpool, seven in Salford and three in Nottingham. Thirteen were in prison.

Who were the Rioters?

  • They ranged in age from 13 to 57
  • A third said they had never been found guilty in court or cautioned
  • The overwhelming majority said gangs played little or no part in what happened.
  • About three-quarters were aged 24 or under, only a small minority, people over 40.
  • Around 80% of interviewees were male, although anecdotal evidence from observers of the riots, suggest the proportion was nearer 90%
  • They came from a wide range of ethnic groups but A slightly larger proportion were from an ethnic minority (50% black, 5% Asian) or of mixed race (18%); this also varied by area: the ethnic makeup of interviewees in Salford and Manchester overwhelmingly white.
  • The general attainment levels were lower than those of the population as a whole: of the adults, a third had no qualification higher than GCSE , one-fifth of the rioters claimed to have no educational qualifications at all, one in 20 said they had a degree.
  • Most had prior experience with the Criminal Justice System – only 32% said they had never been found guilty in a court or been cautioned.

What were the main causes of the riots?

Based on the above interviews, the rioters themselves stated the following five main causes (percentages reporting this as a factor in brackets)

  • Poverty (86%)
  • Policing (85%)
  • Government Policy (80%)
  • Unemployment (79%)
  • The shooting of Mark Duggan (75%)

Of course, if you conducted the research again using a broader sample and different methods, then you might get different results. But based on this evidence, there does not appear to be any support for the New Right’s perspective on what caused the riots…

Sociological (/Criminological) Perspectives on the London Riots

Asking about the ‘causes’ of crime is only one aspect among many in the crime and deviance course. Some of the perspectives on crime look at crime much more broadly.

Functionalism – argues that society needs crime. Rather than looking at crime as a purely negative phenomenon, crime also has positive social functions. The riots, for example, lead to a temporary suspension of inter-gang violence, and, as a media event, it gave the rest of us something unite against, thus increasing unity in society more generally.

Bonds of Attachment Theory (Functionalism) – The cause of deviance is the breakdown or weakening of informal agencies of social control such as the family and community. Criminal activity occurs when the individual’s attachment to society is weakened. This theory would blame poor parenting as the main cause of the riots.

Consensus Subcultural Theory – argues crime is a collective response to the above situation of frustration – If you can’t gain status by getting a job, you seek status by some other means within a subculture (possibly a gang) and riots can offer you an opportunity to gain status by ‘going further than the next person’.

Traditional Marxism – Argues that crime is a response to a Capitalist system that breeds materialism, greed and selfishness. They also point out that many members of the Elite classes are criminals themselves, but it is generally only the powerless that get punished for their criminal acts, while elites tend to avoid punishment. The rioters were largely teenage youths living in poor areas and many got disproportionate punishments for their involvement in the riots, while politicians engaging in criminal acts often get away without punishment.

Interactionists – See criminal behaviour as a response to labelling by agents of social control – mainly the police. Focussing on the riots – Interactionists would argue that police racism over the last 3 decades has led to black youths being disproportionately targeted by stop and search – and it was this history of negative attention from the police that sparked the riots.

Right Realists – Argue that the riots were caused because of a basic breakdown of both informal and formal social control – weak communities and too few police on the streets, and society not being tough enough on crime. Rioters had too much freedom and felt like they could get away with their crimes.

Left-Realism – Argues there are two main causes of crime – Marginalisation and Relative Deprivation – largely borne out by the Guardian research above.

Post-modernism – Argues that the riots are a response to a postmodern society characterised by consumerism, an obsession with self-identity and a quest for excitement. For many the riots were a ‘scene’ where they could ‘play a game’ – engaging in vandalism and challenging the police provide both status and excitement – much more than any nightclub could offer.

2020 update

A 2019 study from academics at Sussex university compared London boroughs which saw rioting with London boroughs where there was no rioting.

They found that deprivation was the most significant predictor of whether a riot would break our or not. Deprivation levels were also positively correlated with the intensity and length of rioting.

They also found a positive correlation between the number of police stop and searches in the previous two years and the likelihood of rioting occurring and conclude that a combination of deprivation and an ‘anti-police’ identity were the main factors which explain the 2011 London riots.

Sociological Perspectives on Punishment

One way of controlling and reducing crime is to punish offenders. Given that punishment typically involves restricting people’s freedom and sometimes inflicting harm on people, it requires some justification as a strategy for crime control. Two main justifications exist for punishment: Crime reduction and retribution. These methods link to different penal policies.

Reduction

One justification for punishing offenders is that it prevents future crimes. This can be done through:

  • Deterrence – Punishing the individual discourages them from future offending – and others through making an example of them. This relates to Durkheim’s Functionalist Theory that crime and punishment reinforce social regulation, where prison sentence for a crime committed reaffirms the boundaries of acceptable behaviour.

  • Rehabilitation – The aim is to change offenders’ behaviour through education so they can earn an ‘honest living’ on release

  • Incapacitation – Removing the capacity for offenders to re-offend through long term prison sentences, cutting of hands, chemical castration or the death penalty.

Retribution

Reducing crime is not the only function of punishment, it also performs a straightforward ‘retributive function’ – in which the criminal is simply punished for harming another person, and the victim gets a sense of satisfaction that the criminal is ‘paying for their crime. This is an expressive rather than an instrumental view of punishment – it expresses society’s outrage at the crime.

Left Realism

Left realists believe that prison alone is an ineffective method at reducing crime. They believe it needs to be combined with the practice of restorative justice…which involves the offender actively doing something to make up for the harm done as a result of their crime. This may involve measures such as reparation, (paying back) mediation, (offender meeting victim) reintegrative ‘shaming’, (facing offenders with the consequences of their actions and family conferencing which seeks to bring offender, victim and members of the community into some form of dialogue and ‘healing’ process. All this is very unlike the anonymous processing and exclusionist shaming of the courts and prison sentences.

Home office research suggests meeting the offender benefits 80% of victims who choose to participate. For some victims it is about forgiveness – letting go of anger in order to move on with their lives. But for many, meeting the offender is about confronting them with the real impact of their crime, asking the questions that never get answered in court, and the hope that – for some offenders at least – understanding the impact of their actions might help to prevent them reoffending.

The research evidence on RJ is stronger than for almost any other criminal justice intervention. Research using randomised control trials (Home Office/Ministry of Justice seven-year, £7m evaluation of the impact of RJ) has found that offenders who met their victim compared to those who did not, the frequency of reoffending fell by 27% (ie 27% less crime after RJ). However, at present fewer than 1% of victims of crime have access to a restorative justice process. (http://www.guardian.co.uk/commentisfree/2010/sep/17/restorative-justice-cuts-crime)

Marxism

According to the Marxist Sociologist David Gordon prison benefits the Capitalist system in three major ways:

  • The imprisonment of selected members of the lower classes neutralises opposition to the system, keeping potential revolutionaries from forming together and taking political action.
  • The imprisonment of many members of the underclass also sweeps out of sight the ‘worst jetsam of Capitalist society’ such that we cannot see it
  • By punishing individuals and making them responsible for their actions, defining these individuals as ‘social failures’ we ignore the failings of the system that lead to the conditions of inequality and poverty that create the conditions which lead to crime. Our attention is diverted away from the immorality and greed of the elite classes.

NB – We are not talking about small numbers here – Focussing on the USA, David Garland argues that we have entered the era of mass incarceration. Approximately 2.3 million people are in jail in the US (about 750/100 000)

Focusing on the UK, the prison population has doubled since 1993 from approximately 40 000 to nearly 90 000 today.

There is evidence to support the Marxist view that it is mainly the marginalised who end up in jail – Looking at stats on prisoners we find that…

10% of men and 30% of women have had a previous psychiatric admission to hospital before they come into prison.

48% of all prisoners are at, or below, the level expected of an 11 year old in reading, 65% in numeracy and 82% in writing.

71% of children in custody have been involved with, or in the care of, social services before entering custody.

NB2 – While Right Realists would claim that locking more people up is a causal factor in the crime rate going down over the last two decades, this claim is challenged. This correlation may be a coincidence – other factors (such as abortion and the rise of ICT meaning more people stay indoors) may also play a role in this).

 Interactionism

Once a person is labelled as deviant, it is extremely difficult to remove that label. The deviant person becomes stigmatised as a criminal or deviant and is likely to be considered, and treated, as untrustworthy by others. The deviant individual is then likely to accept the label that has been attached, seeing himself or herself as deviant, and act in a way that fulfils the expectations of that label. Even if the labelled individual does not commit any further deviant acts than the one that caused them to be labelled, getting rid of that label can be very hard and time-consuming. For example, it is usually very difficult for a convicted criminal to find employment after release from prison because of their label as ex-criminal. They have been formally and publicly labelled a wrongdoer and are treated with suspicion likely for the remainder of their lives.

Total Institutions and The Mortification of the Self

Erving Goffman (1961) argued that places such as mental asylums, concentration camps and prisons function as ‘total institutions’ – places which are closed off to the outside world and where inmates’ lives come under the complete control of the institution.

According to Goffman, becoming an inmate in a total institution involves a process of “mortification of the self” – inmates are subjected to degrading and humiliating treatments designed to remove any trace of individual identity. For instance, personal clothing and items are confiscated, inmates are strip searched, their heads are shaved, and they are issued an ID number. The point of such treatment is to mark a clear separation between the inmates’ former selves and their institutional selves. Inmates are constantly under surveillance and they have no privacy. Minute behaviour is observed and assessed, and if necessary, sanctioned.

As a result of having every aspect of their daily lives controlled, inmates effectively lose the ability to construct their own identities and function independently. Rather than making sick people well, asylums make them more insane, and rather rehabilitating, prisons actually make prisoners more criminal.

Post and Late Modernism

In his classic text, entitled ‘discipline and punish’ Michel Foucault’s points out that punishment has changed from being very direct, immediate and physical – involving torture and sometimes death to being more focused on incarceration and rehabilitation. However, although punishment today may be less severe than in the past, the state has expanded its control over its citizens in more subtle ways and ‘invades’ our private lives much more than at it ever used to. This is especially true when you look at the way criminals are treated today. While prisoners are unlikely to be subjected to torture or death (unless you’re Muslim, black or stupid and live in Texas) they are subjected to an ever increasing array of what Foucault calls ‘technologies of surveillance’ – they are kept under surveillance programmes and are expected to reform their behaviour.

Prison is the most obvious example of this – with prisoners under (potential) constant surveillance, while those who avoid prison might have to subject themselves to being tagged, visit probation officers, or turn up to ‘rehabilitation classes’ (such as drug counselling or anger management) all of which involve surveillance and behavioural modification.

Foucault sees the growth of prison as a means of punishment as reflecting the move from sovereign power to disciplinary power – Sovereign power involves direct physical coercion to get people to obey the laws, and under this system punishments are carried out on people’s physical bodies – punishment is harsh – it is a spectacle.

Today, however, political and economic systems are maintained through ‘disciplinary power’ – power is exercised through surveillance – people change their behaviour because they know they are being watched. Prison seams more humane than physical punishment but in reality it is much more invasive as a means of social control.

NB – As with Marxism above, we are talking about huge numbers 7 million people (1/32 of the population) are either in jail, on probation or parole, and Garland uses the concept of Transcarceration to refer to this shift. Certain people move between various state institutions – from care – to prison – to mental hospital – throughout their whole lives, effectively being under constant surveillance by the state.

David Garland – The Punitive State and The Culture of Control

David Garland argues that there has been a relatively recent shift in attitudes towards punishment.

He argues that in the 1950s the state practised ‘penal welfarism’ – in which the criminal justice system did not just try to catch and punish offenders, but also tried to rehabilitate them, so that they could be reintigrated into society

However, since the 1950s individual freedoms have increased, while social bonds have weakened, life is more uncertain and less predictable, and (despite the fact that crime is now decreasing) the public are more worried about crime than ever.

As a result, the state has now abandoned ‘penal welfarism’, it is much less concerned with rehabilitation and reintegration of prisoners, it’s primary concern is now convincing the public that it is taking a tough approach on crime and reassuring communities that something is being done about crime.

Garland argues that we have now moved into a new era in which a ‘punitive state’ enforces a ‘culture of control’ – there are three main ways in which the state now seeks to control crime and punish offenders:

  • The state increasingly identifies potential groups who are at risk of offending at a young age and take early interventions. This links to the Actuarialism (risk management) strategy referred to in a previous topic.

  • The state locks increasing amounts of people up, Garland argues we have entered the era of ‘mass incarceration’ and ‘transcarceration’.

  • Politicians increasingly use the issue of crime control, and ‘being tough on crime’ as a means to win elections – in effect, crime control has become a political tool which politicians use to win power, rather than being about reducing crime perse.

Evaluations of Garland

  • This is an important contribution in that it draws our attention towards the ‘political nature of crime control – and it helps to explain the increasing prison populations and ‘transcacerated’ population even though crime has been decreasing for decades.

  • This is a rather cynical theory – Garland seems to be saying that politicians today simply use their ‘tough on crime’ approach to get votes and maintain power, rather than trying to do anything which will really address the underlying causes of crime. Is this really the case?

  • Michel Foucault would probably argue that this theory is too simplistic in terms of its understanding of political power – it diverts our attention away from other agencies of social control in preventing/ constructing deviance through surveillance.
