Criminal Justice, Ethnicity and Racism

Both Paul Gilroy and Stuart Hall argue that crime statistics are socially constructed and these statistics do not reflect underlying differences in crime rates. They argue instead that the variations in stop and search and imprisonment rates by ethnicity are mostly explained by differences in stop and search rates of ethnic groups which means a higher proportion of black and Asian criminals are caught and prosecuted compared to white criminals

Look at the statistical evidence below, to what extent does the evidence support Gilroy’s and Hall’s views?

Self-report studies

Self-report studies ask people to disclose details of crimes they committed but not necessarily been caught doing or convicted of. Graham and Bowling (1995) Found that blacks (43%) and whites (44%) had similar and almost identical rates of crime, but Asians actually had lower rates (Indians- 30%, Pakistanis-28% and Bangladeshi-13%).

Sharp and Budd (2005) noted that the 2003 offending, crime and justice survey of 12,000 people found that whites and mixed ethnicity were more likely to say they had committed a crime, followed by blacks (28%) and Asians (21%).

Victim surveys

The British Crime Survey indicated that 44 per cent of victims were able to say something about the offender who was involved in offences against them. Among these, 85 per cent of offenders were said by victims to be ‘white’, 5 per cent ‘black’, 3 per cent ‘Asian’ and 4 per cent ‘mixed’. However, these stats are only for the minority of ‘contact’ offences and very few people have any idea who was involved in the most common offences such as vehicle crime and burglary. Therefore, in the vast majority of offences no reliable information is available from victims about the ethnicity of the criminal.

Prosecution and trial

The Crown Prosecution service (CPS) is responsible for deciding whether a crime or arrest should be prosecuted in court. They base it on whether there is any real chance of the prosecution succeeding and whether it is better for the public that they are prosecuted.

Ethnic minority cases are more likely to be dropped than whites, and blacks and Asians are less likely to be found guilty than whites. Bowling and Phillips (2002) argue that this is because there is never enough evidence to prosecute as it is mainly based on racist stereotyping. In 2006/7 60% of whites were found guilty, against only 52% of blacks, and 44% of Asians.

When cases go ahead members of ethnic minorities are more likely to elect for Crown Court trail rather than magistrates (even through Crown Courts can hand out more severe punishments), potentially because of a mistrust of magistrates.

Sentencing and prison

Jail sentences are more likely to be given to Blacks (68%) compared to Whites (55%) or Asians (59%), whereas Whites and Asians were more likely to receive community services. But this could be due to the seriousness of some ones offence of previous convictions.

Hood (1992) found that even when the seriousness of an offence and previous convictions were taken into account Black men were 5x more likely to be jailed and given a sentence which is 3 months (Asians 9 months) longer than whites.

Social Class and Crime

Prison statistics suggest the lower class commit more crime, which consensus theorists and right realists accept, but Marxists believe the crimes of the elite are hidden and yet more harmful.

In this post we examine the relationship between social class and crime.

According to available statistics, social class background is correlated with crime rates and victimisation rates. However, there are significant limitations with the statistics on social class and crime and we will examine these here.

We then apply some of the theories of crime and deviance to see how they explain the relationship between social class and crime:

  • Consensus theory explains the higher rates of working class crime in terms of  differential access the working classes and middle classes have in relation to the legitimate opportunity structure, which generates different cultural responses
  • Interactionism broadly rejects the consensus theory arguing that the higher rates of working class crime are a social construction
  • Marxism recognises the fact that the high levels of working class crime are a social construction in that emphasises the role of crimogenic capitalism in generating crime.
  • Right Realism focuses our attention on the underclass, rather than the working class as the main cause of crime in society today, while left realism sees crime as an outgrowth of inequality and marginalisation, without blaming Capitalism per se as Marxists do.

Statistics on social class and crime

The UK government does not routinely collect statistics on the relationship between social class and crime. Instead, we have to rely on proxies for social class such as income, deprivation and education levels. 

Prisoners are 3-4 times less likely to have GCSEs in English or Maths. This suggests a correlation between low levels of educational achievement and crime. 

  • Those in deprived areas are more likely to be victims of crime. 
  • Those in higher income households are more likely to be victims of crime.
  • Prisoners have low levels of educational achievement 

50% of prisoners had literacy levels at Entry Level 3 or below, and 55% had numeracy skills at Entry Level 3 or below. (Level 1 is next, then Level 2, which is GCSE.) 

Only 13% of prisoners have English at GCSE level, and less than 10% have maths. This compares to national GCSE pass rates in 2023 of 52% in English and 55% in maths.

‘Social Class’ and victimisation statistics 

Depending on whether you look at the general levels of deprivation in an area or household income, you get a different picture of the relationship between social class and crime. 

The proportion of adults in England and Wales who were victims of all crime in the year ending to March 2023 was slightly higher in the most deprived areas compared to the least deprived areas. However, if we look at the statistics by household income we find that households with an annual income of £52000 or more have the highest rates of victimisation, and those with the lowest income the lowest rates of victimisation.  

Victimisation rates for all crime:

  • Most deprived 20% of areas – 10.7%. 
  • Least deprived 20% of areas – 9.8%.
  • Households with income £52 000 or above – 12.7%.
  • Households with income below £10 400 –  9.6%.

So it would seem that it is houses with the highest incomes in the most deprived areas that are most likely to be victims of crime. 

Limitations with statistics on ‘social class’ and crime

  1. The above statistics are proxies for social class, not actually measuring social class, only aspects of it.
  2. Those in the least deprived areas or in lower income households may be less likely to report victimisation as they are more suspicious of middle class researchers compared to more middle class respondents. 
  3. Crime surveys may not ask about the types of crime the deprived are more likely to be victims of, such as health and safety at work breaches. 
  4. Where prisoners are concerned, from a Marxist perspective all classes commit crime but the middle classes and elite are less likely to get caught. Thus you would expect to see those with low educational achievement in prison, because these are the people the criminal justice system focuses on.

Consensus Theories, Social Class and Crime 

Consensus theories generally accepted the fact that crime rates were higher among the lower social classes and set out to explain why – two theories which explicitly focused on the differences between working class culture and crime were Strain theory and Status Frustration theory.

Robert Merton: Strain Theory, Blocked Opportunities and Working Class Innovation

Robert Merton argued that crime increased when there was a strain (or gap) between society’s success goals (achieving material wealth) and the available opportunities to achieve those goals through legitimate means (having a well-paying job). Merton called this imbalance between goals and the ability to achieve them ‘anomie’.

Merton argued that crime was higher among the working classes because they had fewer opportunities to achieve material success through legitimate means and were thus more likely to adopt innovative cultural responses in order to achieve material success through criminal means – through burglary or drug dealing, for example.

Merton saw crime as a response to the inability of people to achieve material wealth, emphasising the role of material or economic factors.

Albert Cohen: Status Frustration and Working Class Subcultures

Albert Cohen put more emphasis on cultural factors (values and status) rather than material factors in explaining working class crime.

Cohen argued that working class boys strove to emulate middle-class values and aspirations, but lacked the means to achieve success. This led to status frustration: a sense of personal failure and inadequacy.

In Cohen’s view they resolved their frustration by rejecting socially acceptable values and patterns of acceptable behaviour. Because there were several boys going through the same experiences, they end up banding together and forming delinquent subcultures.

This delinquent subculture reversed the norms and values of mainstream culture, offering positive rewards (status) to those who were the most deviant. Status was gained by being malicious, intimidating others, breaking school rules or the law and generally causing trouble.

This pattern of boys rejecting mainstream values and forming delinquent subcultures first started in school and then becomes more serious later on, taking on the form of truancy and possibly gangs.

Interactionism, Social Class and Crime

The main piece of sociological research which has specifically examined the relationship between the police and the social class background of offenders is Aaron Cicourel’s ‘Power and The Negotiation of Justice’ (1968)

Cicourel argued that it was the meanings held by police officers and juvenile officers that explained why most delinquents come from working class backgrounds, and that the process of defining a young person as a delinquent was complex, involving mainly two stages of interactions based on sets of meanings held by the participants.

The first stage is the decision by the police to stop and interrogate an individual. This decision is based on meanings held by the police of what is ‘strange’, ‘unusual’ and ‘wrong’. Whether or not the police stop and interrogate an individual depends on where the behaviour is taking place and on how the police perceive the individual(s). Whether behaviour is deemed to be ‘suspicious’ will depend on where the behaviour is taking place, for example an inner city, a park, a suburb. If a young person has a demeanour like that of a ‘typical delinquent’ then the police are more likely to both interrogate and arrest that person.

The Second Stage is that the young person is handed over to a juvenile delinquent officer. This officer will have a picture of a ‘typical delinquent’ in his mind. Factors associated with a typical delinquent include being of dishevelled appearance, having poor posture, speaking in slang etc. It follows that Cicourel found that most delinquents come from working class backgrounds.

When middle class delinquents are arrested they are less likely to be charged with the offence as they do not fit the picture of a ‘typical delinquent’. Also, their parents are more able to present themselves as respectable and reasonable people from a nice neighbourhood and co-operate fully with the juvenile officers, assuring them that their child is truly remorseful.

As a result, the middle class delinquent is more likely to be defined as ill rather than criminal, as having accidentally strayed from the path of righteousness just the once and having a real chance of reforming.

Cicourel based his research on two Californian cities, each with a population of about 100, 000. both had similar social characteristics yet there was a significant difference in the amount of delinquents in each city. Cicourel argued that this difference can only be accounted for by the size, organisation, policies and practices of the juvenile and police bureaus. It is the societal reaction that affects the rate of delinquency. It is the agencies of social control that produce delinquents.

Marxism, Social Class and Crime

Marxists argue that while working class crime does exist, it is a rational response to crimogenic capitalism. Moreover, all class commit crime, and the crimes of the elite are more harmful than street crime, but less likely to be punished.

Crimogenic Capitalism

  1. Capitalism encourages individuals to pursue self-interest before everything else.
  2. Capitalism encourages individuals to be materialistic consumers, making us aspire to an unrealistic and often unattainable lifestyle.
  3. Capitalism in its wake generates massive inequality and poverty, conditions which are correlated with higher crime rates.

Marxist Sociologist David Gordon says that Capitalist societies are ‘dog eat dog societies’ in which each individual company and each individual is encouraged to look out for their own interests before the interests of others, before the interests of the community, and before the protection of the environment. If we look at the Capitalist system, what we find is that not only does it recommend that we engage in the self-interested pursuit of profit is good, we learn that it is acceptable to harm others and the environment in the process.

Marxists theorise that the values of the Capitalist system filter down to the rest of our culture. Think again about the motives of economic criminals: The burglars, the robbers, and the thieves. What they are doing is seeking personal gain without caring for the individual victims.

The Capitalist system is also one of radical inequality. At the very top we have what David Rothkopf calls the ‘Superclass’ , mainly the people who run global corporations, and at the very bottom we have the underclass (in the developed world) and the slum dwellers, the street children and the refugees in the developing world.

The Sociologist Zygmunt Bauman points out that the super wealthy effectively segregate themselves from the wealthy, through living in exclusive gated communities and travelling in private jets and armoured vehicles with security entourages. If people can afford it, they move to a better area, and send their children to private schools. However, this doesn’t prevent the poor and the rich from living side by side.

Marxists argue that the visible evidence of massive inequalities give people at the bottom a sense of injustice, a sense of anger and a sense of frustration that they are not sharing in the wealth being flaunted in front of them (the flaunting is the point is it not?) As a result, Capitalism leads to a flourishing of economic crime as well as violent street crime.

William Chambliss even goes so far as to say that economic crime ‘’represents rational responses to the competitiveness and inequality of life in capitalist societies”.  As we have seen from previous studies. Drug dealers see themselves as innovative entrepreneurs. So internalised is the desire to be successful that breaking the law is seen as a minor risk.

Marxists hold that more egalitarian societies based on the values of the co-operation and mutual assistance, have lower crime rates.

Key Concepts

White Collar Crime: Crimes committed in the furtherance of an individual’s own interests, often against the corporations of organisations within which they work.

Corporate Crime: Those crimes committed by or for corporations or businesses which act to further their interests and have a serious physical or economic impact on employees, consumers and the general public. The drive is usually the desire to increase profits.

The Crimes of the elite are more costly than street crime

Marxists argue that although they are hidden from view, the crimes of the elite exert a greater economic toll on society than the crimes of the ‘ordinary people’. Laureen Snider (1993) points out that the cost of White Collar Crime and Corporate Crime to the economy far outweighs the cost of street crime by ‘typical’ criminals.

The Cost of Financial Crime (Fraud)

Organisations such as Corporate Watch and…. Multinational Monitor, suggest that Corporate Fraud is widespread.  The General Accounting Agency of the USA has estimated that 100s of savings and loans companies have failed in recent years due to insider dealing, failure to disclose accurate information, and racketeering. The cost to the taxpayer in the USA of corporate bail outs is estimated to be around $500 billion, or $5000 per household in the USA.[1]

Case Study – Bernie Madoff’s $65 billion Ponzi scheme

In 2009 the disgraced financier Bernie Madoff was sentenced to the maximum 150 years in prison for masterminding a $65bn (£38bn) fraud that wrecked the lives of thousands of investors.

The US district judge Denny Chin described the fraud as “staggering” and said the “breach of trust was massive” and that a message was being sent by the sentence. There had been no letters submitted in support of Madoff’s character, he said. Victims in the courtroom clapped as the term was read out.

Madoff pleaded guilty to 11 counts of fraud, theft and money laundering. The sentencing, in what has been one of the biggest frauds ever seen on Wall Street, was eagerly anticipated. Described by victims in written testimony as a “thief and a monster”, Madoff has become an emblem for the greed that pitched the world into recession. Nearly 9,000 victims have filed claims for losses in Madoff’s corrupt financial empire.

Madoff masterminded a huge “Ponzi” scheme. Instead of investing client’s money in securities, it was held with a bank and new deposits used to pay bogus returns to give the impression that the business was successful. At the time of his arrest in December, he claimed to manage $65bn of investors’ money, but in reality there was just $1bn left.

Right Realism/ Underclass Theory and Crime 

Right Realists disagree with Marxists – Right Realists point to the underclass as being responsible for a disproportionate amount of crime in society.

Charles Murray and the Underclass

 Charles Murray argued that changes to family structure was responsible for much of the increase in the crime rate in the 1970s and 80s – he largely attributes the growth of crime because of a growing underclass or ‘new rabble’ who are defined by their deviant behaviour and fail to socialise their children properly. The children of the underclass fail to learn self-control and also fail to learn the difference between right and wrong.

The underclass has increased because of increasing welfare dependency. Murray argues that increasingly generous welfare benefits since the 1960s have led to increasing numbers of people to become dependent on the state. This has led to the decline of marriage and the growth of lone parent families, because women can now live off benefits rather than having to get married to have children. This also means that men no longer have to take responsibility for supporting their families, so they no longer need to work.

According to Murray, lone mothers are ineffective agents of socialisation, especially for boys. Absent fathers mean than boys lack paternal discipline and appropriate male role models. As a result, young males turn to other, delinquent role models on the street to gain status through crime rather than supporting their families through a steady job.

Increasing crime is effectively a result of children growing up surrounded by delinquent, deviant criminal adults which creates a perfect crimogenic environment.

Unemployment and Crime

A recent comparison 4.3 million offenders in England and Wales whose names appeared in court records or the Police National Computer with separate benefits records held by the Department for Work and Pensions revealed that more than 1.1 million of the 5.2 million people claiming out-of-work benefits had a criminal record, or 22 per cent. This means that people who are claiming unemployment benefit are more than twice as likely to have a criminal record as those who are not.  (Source: More than a fifth of people on unemployment benefits have a criminal record.)

NEETS and Crime

NEETS stands for young people aged between 16 and 24 Not in Education, Employment or Training. They first came to the government’s attention in the mid 2000s when they numbered 1.1m. At that time, a study by the Department for Education and Skills (DfES) conservatively estimated that each new NEET dropping out of education at 16 will cost taxpayers an average of £97,000 during their lifetime, with the worst costing more than £300,000 apiece.

Their impact on crime, public health and antisocial behaviour was so marked that the study found that a single 157,000-strong cohort of 16 to 18-year-old NEETs would cost the country a total of £15 billion by the time they died prematurely in about 2060. They are, says the study, 22 times more likely to be teenage mothers; 50% more likely to suffer from poor health; 60% more likely to be involved with drugs and more than 20 times more likely to become criminals.

Left Realism, Social Class and Crime

Left Realists Lea and young conclude that they can explain this using the following key concepts; relative deprivation, marginalisation and subculture.

Relative deprivation

 Lea and Young argue that crime has its roots in deprivation, but deprivation itself is not directly responsible for crime – for example, living standards have risen since the 1950s, so the level of deprivation has fallen, but the crime rate is much higher today than it was in the 1950s.

Left Realists draw on Runciman’s (1966) concept of relative deprivation to explain crime. This refers to how someone feels in relation to others, or compared with their own expectations.

The concept of relative deprivation helps to explain the apparent paradox of increasing crime in the context of an increasing wealthy society. Although people are better off today, they have a greater feeling of relative deprivation because of the media and advertising have raised everyone’s expectations for material possessions – we are wealthier, but we feel poorer, and thus there is more pressure to get more stuff to keep up with everyone else, which generates historically high crime rates.

Marginalisation

 This is where people lack the power or resources to fully participate in society. According to Left Realists marginalised groups lack both clear goals and organisations to represent their interests. Groups such as workers have clear goals (such as wanting better pay and conditions) and organisations to represent them (such as trades unions), and as such they have no need to resort to violence to achieve their goals.

By contrast, unemployed youth are marginalised – they have no specific organisation to represent them and no clear sense of goals – which results in feelings of resentment and frustration. Having no access to legitimate political means to pursue their goals, frustration can become expressed through violence.

Subculture

Left Realists see subcultures as a group’s collective response to the situation of relative deprivation, and they draw on Cohen’s theory of status frustration to explain how they emerge. There are many different subcultural adaptations to blocked opportunities, and not all result in crime – but those subcultures which still subscribe to the mainstream values of material wealth but lack legitimate opportunities to achieve those goals.

Crude – The Real Cost of Oil

This documentary is the story of a lawsuit by tens of thousands of Ecuadorans against Chevron over contamination of the Ecuadorean Amazon.The case, worth $27 billion is one of the largest and most controversial legal cases on the planet.

The Plaintiffs are suing Chevron for damage cause by 30 years of operation in the Amazon between 1960-1990. The plaintiffs claim that Texaco – which merged with Chevron in 2001 – spent three decades systematically contaminating one of the most biodiverse regions on Earth, poisoning the water, air and land. The plaintiffs allege that the pollution has created a “death zone” in an area the size of the Rhode Island, resulting in increased rates of cancer, leukemia, birth defects, and a multiplicity of other health ailments. They further allege that the oil operations in the region contributed to the destruction of indigenous peoples and irrevocably impacted their traditional way of life.

Chevron fights the claims, charging that the case is a complete fabrication, perpetrated by “environmental con men” who are seeking to line their pockets with the company’s billions.

In some respects the film is depressing, in others enlightening – it’s only being fought in Ecuador because Chevron demanded so, after spending 9 years dillydallying in American courtrooms, to get the case moved from the USA to Ecuador.

The film mostly follows the legal team representing the Indians – and it’s a bleak picture – we learn, for example, that the brother of one of them was tortured and  murdered, and we also get see what a drawn out process this legal battle is – most of the time this team looks on the edge of exhaustion – but not as exhausted as some of the people living near Chevron’s oil spills who are suffering from Cancer.

You also get to see and hear from Chevron’s lawyers – who play a cunning game of ‘it’s  not our fault, you have to blame the government that allowed us to drill here’ or ‘OK –  we see that there’s oil here – but how can you prove it’s a result of our drilling processes rather than just natural seepage’? and similarly ‘how can you prove the skin rashes are due to oil and not just poor sanitation’?

The Movie doesn’t conclude, as at the time of production the legal battle was ongoing – but in Feburary 2011 Chevron were found guilty of environmental damage and slapped with a $9 billion dollar fine – only 1/3rd of what the Plaintiffs were asking for.

Chevron of course, rather than pay the fine are fighting back – arguing that the lawyers in the Movie have been engaged in Fraud in that they’v emade false allegations against Chevron, and they hold the state owned oil company of Equador, which took over prodcution since 1990, responsible for the pollution.

The Role of the Police in Controlling and Reducing Crime

This post simply applies a few perspectives to the role of the police in society

Consensus Theory and Right Realism

The Consensus Approach views the police as a neutral force who generally do a good job, having a close working relationship with law abiding citizens and responding effectively to the needs of local communities, defending them against the anti-social and criminal behaviour of a minority people. From this point of view most failings of the police are due to lack of funding and there not being enough police on the streets.

Right Realists – believes more emphasis should be put on Zero Tolerance policing – the main role of the police is to work with local communities and businesses to target those areas and individuals who are persistently anti-social and criminal and to clamp down hard on even minor offences. This obviously involves targeting weapon and drugs dealers, but also clamping down on anti-social behaviour, and the police being very visible on the streets to act as a physical deterrent against crime. Obviously Zero Tolerance policies would also involve the police working closely with the courts after offences have taken place.

Zero Tolerance Policing can incorporate ‘military style policing’ where the police act against whole communities.

Left Realism

Left Realists believe that ‘Zero Tolerance’ policies are legitimate but that the police should spend more time getting to know local communities – which involves a less militaristic approach to policing, speaking to and befriending local youths rather than pouring their beer down the drain and constantly ‘moving them on’. This will also involve more referrals to social outreach projects. Policing for Left Realists is more about working with communities and not alienating them through ZT in order to prevent crime in the very long term. Community Support Officers are a good example of ‘community policing’ – they do not have enough powers to engage in Zero Tolerance approaches.

Marxism

According to Marxists the police engage in ‘selective law enforcement’
David Gordon argues that the police mainly focus on policing working class (and underclass) areas and the justice system mainly focuses on prosecuting working and underclass criminals. By and large the system ignores the crimes of the elite and the middle classes, although both of these classes are just as likely to commit crime as the working classes.

Marxists argue that the government puts more police on the streets in working class and underclass estates and underfunds the policing of businesses and Corporations engaging in Corporate Crime. Evidence for this lies in Tombs and Whyte’s study which found that The Financial Services authority (which investigates complex financial crimes) and the Health and Safety Executive (which investigate health and safety breaches by Corporations have had their funding cut in recent years.

Interactionism

Howard Becker suggests that police interpret working class and middle class behaviour differently – In a low-income neighbourhood, a fight is more likely to be defined by the police as evidence of delinquency, but in a wealthy area as evidence of high spirits. The acts are the same, but the meanings given to them by the audience (in this case the public and the police) differ.

Those who have the power to make the label stick thus create deviants or criminals. Eventually, ‘over-policing’ alienates marginalised groups and makes it more likely that they will actually turn to crime (a Self-Fulfilling Prophecy).

Aaron Cicourel also developed a class-based analysis of how agents of social control interact differentially with people from different class backgrounds in ‘The Negotiation of Justice’ – he suggested that middle class parents have more power to ‘negotiate’ effectively with the authorities and are more able to get their children off being given deviant labels – by convincing the police that their kids are really ‘good kids’ and their anti-social behaviour is a ‘one off’.

The Killer Clown Craze

The societal response to the so called ‘Killer Clown Craze‘ seems like a good example of a moral panic. Piers Morgan (moral entrepreneur supremo) has waded in against the craze, and as soon as he gets involved in anything, that’s a sure sign of moral panic). Twenty years ago, people dressed in scary clown costumes would have been regarded as ‘Halloween pranksters’, today they’re regarded as public menaces who are a threat to public order and child well-being.

Thames Valley Police reported that

‘In the last 24 hours we have been called to 14 incidents across the region where people have reported being intimidated or frightened by others dressed as clowns. This follows the report of other incidents across the country which have been widely reported in the national media. While we don’t want to be accused of stopping people enjoying themselves we would also ask those same people to think of the impact of their behaviour on others and themselves.’ 

The public have been warned that dressing up as a clown with the intent to scare people could result in a criminal record, and children have been advised to phone child line if they are distressed by such sightings. Staffordshire police have further advised that people don’t ‘like’ Killer Clown pages on Facebook.

Maybe the chainsaw wielding clowns are taking this a step-too far, but as far as I can see, most of the incidents are harmless pranks, meaning the panic over this is almost certainly disproportionate, possibly a response to living in a culture of fear in which paranoid parents construct children as delicate objects in need of protection. Surely 30 years ago clown pranks would have been laughed off as funny?

This is also a great example of a ‘hyperreal’ deviant phenomenon – some people are even dressing up as superheros and chasing the Killer Clowns…

Donald Trump’s Downfall

Donald Trump’s downfall is a useful example of how Synoptic Surveillance can bring down the powerful – It looks like his chances of winning the US election are now extremely slim after video footage came to light of him engaged in what he thought was a private conversation in which he described his failure to ‘fuck’ (his words) a married T.V. presenter even thought he’d ‘moved on her like a bitch’, shortly after he himself had just married. He also boasted of groping women in the same conversation.

Synoptic Surveillance is a concept developed by Thomas Mathiesson to describe how surveillance is now carried out by a diverse range of people, rather than just the state keeping citizens under surveillance – as a result power is now more widely dispersed and those with political power are subject to more control from below, through journalistic surveillance for example.

Maybe the next moral panic will consist of people dressing up in Donald Trump masks groping women?  (‘Honest love, it was just a joke’.)

Evaluating the The New Right View of the Family

The New Right believe that the traditional nuclear family is best and are critical of other ‘non-standard’ family types such as lone parent and reconstituted families.

CIVITAS is one of the best examples of an organisation which represents the New Right View of the Family, and the decline of the nuclear family and increase the the number of single parent families is one of the social trends it focuses on.

In one of it’s documents, entitled ‘Experiments in Fatherless Living‘ CIVITAS focuses on the consequences of rising number of single parent families for both children and society. Just some of the problems they single out include the fact that:

Problems with Lone mothers

  • Are poorer – one mothers are twice as likely as two-parent families to live in poverty at any one time (69% of lone mothers are in the bottom 40% of household income versus 34% of couples with children).
  • Are more likely to have mental health problems – At the age of 33, divorced and never-married
  • were 2.5 times more likely than married mothers to experience high levels of psychological distress.
  • may have more problems interacting with their children. Young people in lone-parent families were 30% more likely than those in two-parent families to report that their parents rarely or never knewwhere they were

Children from Lone Parent families

  • Among children aged five to fifteen years in Great Britain, those from lone-parent families were twice as likely to have a mental health problem as those from intact two-parent families (16% versus 8%).
  • Have more trouble in school – After controlling for other demographic factors, children from lone-parent households were 3.3 times more likely to report problems with their academic work, and 50% more likely to report difficulties with teachers
  • Analysis of 35 cases of fatal abuse which were the subject of public inquiries between 1968 and 1987 showed a risk for children living with their mother and an unrelated man which was over 70 times higher than it would have been for a child with two married biological parents.
  • Are more likely to run away from home – children from lone-parent families are twice as likely to run away from home as those from two-birth-parent families (14% compared to 7%).

Criticisms of the New Right view of single parents 

This text, Charles Murray and The Underclass (especially from page 62 – ‘The Focus on Single Mothers’) provides some useful criticisms of the above statistics – As follows:

‘Murray’s thesis may have been exaggerated for effect, so as to get his main point over, but making scapegoats of single mothers for society’s ills does not help us to approach the serious issues raised by the growing proportion of one-parent families.

This growth has to be seen in the context of changes in social attitudes across the wider society. We live in an age when over 90 per cent of those aged between 18 and 34 do not consider pre-marital sex to be particularly wrong, and when divorce and cohabitation are increasing and are being seen as acceptable at all levels of society.

We may want to seek ways to counter these developments at an individual level, but is not easy to see how we can turn back the clock to a less permissive age—short of a massive religious revival or draconian laws which attempt to control private behaviour between adults.’

Sociological Theories of Consumerism and Consumption

consumerism and consumptionMany of us spend a lot of time thinking about the things we might consume, and how we might consume them, and we do this not only as individuals, but as friends, partners, and families, and so intensely do we think about our consumption practices that the things we buy and the experiences we engage which are linked to them become invested with emotional significance and central (crutches) to our very identities.

The consumption of goods and services is so thoroughly embedded into our ordinary, everyday lives that many aspects of its practice go largely unquestioned – not only the environmental and social consequences have got lost on the way, but also they very notion that consumption itself is a choice, and that, once our basic needs are met, consumption in its symbolic sense is not necessary and thus is itself a choice.

In sociological terms one might say that contemporary reflexivity is bounded by consumption – that is to say that most of the things most of us think about in life – be they pertaining to self-construction, relationship maintenance, or instrumental goal-attainment, involve us making choices about (the strictly unnecessary) things we might consume.

Even though I think that any attempt to achieve happiness through consumption will ultimately result in misery, I would hardly call anyone who tries to do so stupid – because all they are going is conforming to a number of recent social changes which have led to our society being based around historically high levels of consumption.

There are numerous explanations for the growth of a diverse consumer culture and thus the intense levels of unnecessary symbolic consumption engaged in by most people today – the overview taken below is primarily from Joel Stillerman (2015) who seems to identify five major changes which underpin recent changes in consumption since WW2.

The first explanation looks to the 1960s counter culture which despite having a reputation for being anti-consumerist, was really more about non-conformity, a rejection of standardised mass-consumption and promoting individual self expression. Ironically, the rejection of standardised consumption became a model for the niche-marketing of today, much of which is targeted towards people who wish to express themselves in any manor of ways – through clothing, music, foodism, craft beers, or experiences. Some members of the counter culture in fact found profit in establishing their own niche-consumer outlets, with even some Punks (surely the Zenith of anti-consumerism?!) going on to develop their own clothing brands.

A second discussion surrounding the normalisation of consumerism centres around changes in the class structure, following the work Bourdieu and Featherstone (2000). Basically these theorists see the intensification of consumption as being related to the emergence of the ‘new middle classes’ as a result of technological innovations and social changes leading to an increase in the number of people working in jobs such as the media and fashion.

Mike Featherstone focuses on what he calls the importance of ‘cultural intermediaries’ (who mainly work in the entertainment and personal care industries) who have adopted an ‘ethic of self-expression through consumption’ – in which they engage in self-care in order to improve their bodies and skills in order to gain social and economic capital.

The values of these early adopters has gradually filtered down to the rest of the population and this has resulted in the ‘aestheticisation of daily life’ – in which more and more people are now engaged in consumption in order to improve themselves and their social standing – as evidenced in various fitness classes, plastic surgery, and a whole load of ‘skills based’ pursuits such as cookery classes (yer signature bake if you like).

A third perspective focuses on individualisation – as advanced by the likes of Zygmunt Bauman and Ulrich Beck.

In their view, after World War II, universal access to higher education and social welfare benefits in Europe led to the erosion of traditional sources of identity provided by family, traditional authority, and work. Today, individuals are ‘free’ from the chains of external sources of identity, but this freedom comes at a price. Individuals are now compelled to give meaning to their lives without the certainty that they are making the right choice that in the past had come from tradition. Individuals are forced to be reflexive, to examine their own lives and to determine their own identities. In this context, consumption may be a useful vehicle for constructing a life narrative that gives focus and meaning to individuals.

As I’ve outlined in numerous blog posts before, Bauman especially sees this is a lot of work for individuals – a never ending task, and a task over which they have no choice but to engage in (actually I disagree here, individuals do have a choice, it’s just not that easy to see it, or carry it through!).

Fourthly, Post-modern analyses of consumption focus on the increasing importance of individuals to consumption. Building on the work of Lytoard etc. Firat and Venkatesh (1995) argue that changes to Western cultures have led to the erosion of modernist ideas of progress, overly simplified binary distinctions like production and consumption and the notion of the individual as a unified actor. They suggest that in contemporary societies production and consumption exist in a repeating cycle and retail cites and advertiser have increasingly focussed on producing symbols which individuals consume in order to construct identities.

These changes have led to increasing specialising of products and more visually compelling shopping environments, and F and V argue that these changes are liberating for individuals and they seek meaning and identity through consumption, which they can increasingly do outside of markets.

Fifthly – other researches have looked at the role of subcultures in contemporary society, where individuals consume in order to signify their identity as part of a group, and doing so can involve quite high levels of consumption, even if these groups appear quite deviant (McAlexander’s 1995 study of Harley Davidson riders looks interesting here, also Kozinet’s study of Star Trek fans).

Something which draws on numbers 3,4 and 5 above is the concept of consumer tribes (developed by Cova et al 2007) which are constantly in flux, made up by different individuals whose identities are multiple, diverse and playful – individuals in fact may be part of many tribes and enter and exit them as they choose.

Finally, Stillerman points out that underlying all of the above are two important background trends

  • Firstly, there are the technological changes which made all of the above possible – the transport links and the communications technologies.
  • Secondly there is the (often discussed) links to the global south as a source of cheap production.

Very finally I’m going to add in one more thing to the above – underlying the increase in and diversification of consumption is the fact that time has sped up – in the sense that fashions change faster than ever and products become obsolete faster than ever – hence putting increasing demands on people to spend more time and money year on year to keep up on the consumer treadmill….

So there you have it – there are numerous social trends which lie behind the increase in and diversification of consumption, so the next time you think you’re acting as an individual when you’re getting your latest tattoo, maybe think again matey!

Lies, Damn Lies, and The Apprentice?

Or is Alan Sugar some kind of Calvinist God?

‘One in four entrepreneurs who start businesses fail within the first 24 months…. Already in this process I have invested £1.25 million pounds in 5 businesses, and they haven’t failed, and the reason they haven’t failed is because they’re being mentored by me’.

While the first two statements above may well be true, the idea that the crucial factor in the last five winners’ enterprises succeeding is Alan’s mentoring is possibly nonsense – a more likely reason Sugar’s start-ups have all succeeded is that of the 18 candidates or so who start the show every year, at least 10 of them have been cherry-picked because they’ve got very sensible business ideas.

The chances are that of all of the start-ups Sugar ends up with would almost certainly have succeeded if the candidates had just sought out venture-capital, given that he’s got an enormous pool of genuine talent to start with (at least 6 are guff-candidates, but there’s always enough sense in there too), and that then gets whittled down further.

 

 

Key Concepts for A Level Sociology – Crime and Deviance

A list of definitions of some of the key concepts relevant to the A level sociology crime and deviance module.

Many of the concepts below tie in with sociological perspectives on crime and deviance.

Anomie

Where modern social systems encourage excessive individualism – as a consequence there is a general lack of agreement around norms and values – some commentators describe anomie as a state of normlessness.

Anomie was a key part of Merton’s Strain Theory of Deviance.

Bonds of Attachment

Hirschi argued that when an individual is more attached to society they are less likely to commit crime. He theorised that there were 4 main bonds of attachment – commitment, attachment, involvement and belief. For more details please see this post: Hirschi’s Control Theory of Crime.

Broken Windows Theory

A theory of crime developed in the 1980s and associated with Right Realism. Broken Windows theory states that crime increases in areas where there are high levels of ‘social disorder’, characterised by such things as high levels of litter, graffiti and broken windows. These signs give off the impression that people in the area don’t care, and that there are low levels of informal social control, and criminals are thus drawn to such areas. As a result, social disorder and crime increases further.

Context Dependency Deviance

Whether or not an act is deviant depends on the society in which the act takes place, the historical period, and the actors present. The context dependency of deviance emphasises the fact that the same form of behaviour can be considered deviant in one society, but not deviant in another.

Corporate Crime

Crimes committed by or for corporations or businesses which act to further their interests and have a serious physical or economic impact on employees, consumers and the general public. The drive is usually the desire to increase profits.

Crime

The breach of rules or laws for which some governing authority can ultimately prescribe a punishment – depending on the society this might ultimately mean imprisonment or the death penalty.

Crimogenic Capitalism

The Marxist idea that the exploitative capitalist system generates crime. According to Marxists, the self-interested pursuit of profit lies at the heart of the Capitalist system. The means whereby the Capitalist class get rich is by exploiting workers through paying them as little as possible to increase their profits, and they also encourage materialism, to increase demand for the goods they produce. A final way capitalism generates crime is by creating inequality – resulting in a significant number of people at the bottom of society (the underclass) who are effectively unable to consume at a reasonable level.

Dark figure of crime

The amount of unreported, or undiscovered crime. These are the crimes which do not appear in Official Police Statistics.

Deviance

Behaviour that varies from the accepted standard of normal behaviour in society. It implies that an individual is breaking social norms in a negative way.

Dog Eat Dog Society

A phrase associated with Marxist Sociologist David Gordon who said that capitalist societies are ‘dog eat dog societies’ in which each individual company and each individual is encouraged to look out for their own self-interest before the interests of others, before the interests of the community, and before the protection of the environment.

Ideology

A set of cultural beliefs, values, and attitudes that underlie and justify either the status quo or movements to change it. The culture of every social system has an ideology that serves to explain and justify its own existence as a way of life. In Sociology, Marxists use the term the ‘dominant ideology’ to refer to the world-view of the ruling class, which they present to everyone else as normal – their world view passes of inequality and exploitation as normal and natural, thus justifying their existence.

Ideological Functions

The idea that institutions such as schools and the media teach a set of norms and values which work in the interests of the powerful and prevent social change. For example, Marxists say the education system performs ‘ideological functions’ for the Capitalist system and the Bourgeois: they believe that the norms of punctuality and acceptance of authority and hierarchy prepares us for our future exploitation at work, which benefits future employers more than workers.

Labelling

Labelling is the process of pre-judging/ categorising an individual based on superficial characteristics or stereotypical assumptions. For example when a teacher decides a scruffy looking student is not intelligent.

Moral Entrepreneurs

A moral entrepreneur is an individual, group or formal organization that seeks to influence a group to adopt or maintain a norm. Moral entrepreneurs are those who take the lead in labelling a particular behaviour and spreading or popularizing this label throughout society.

Neutralisation of Opposition

In Marxist theory resistance to capitalism and eventual revolution should come from the working classes once they realise the injustice of the high level of exploitation they face. However, according to Marxist criminologists, the criminal justice system works to get rid of opposition by selectively locking up working class (Rather than middle class) criminals which prevents resistance and revolution. Selective law enforcement does this in three main ways:

  1. By literally incarcerating (‘incapacitating) thousands of people who could potentially be part of a revolutionary movement.
  2. By punishing individuals and making them responsible for their actions, defining these individuals as ‘social failures’ we ignore the failings of the system that lead to the conditions of inequality and poverty that create the conditions which lead to crime.
  3. The imprisonment of many members of the underclass also sweeps out of sight the ‘worst jetsam of Capitalist society’ such that we cannot see it, thus we are less aware of the injustice of inequality in society.

Official Crime Statistics

Official Statistics are numerical information collected by the government and its agencies – the two main types of crime statistics collected by government agencies are Police Recorded Crime, and the Crime Survey of England and Wales. Crime statistics also encompass Prison Statistics, which include information about the numbers and characteristics of prisoners.

Police recorded Crime

All crimes reported to and recorded by the police. Police forces around the country record crime in categories that are outlined in the Home Office counting rules. These include: violence against the person, sexual offences, robber, burglary, theft, handling stolen goods, fraud and forgery, criminal damage, drug offences and ‘other offences’.

Rational Choice Theory 

Believes individuals make rational (logical) decisions about whether or not to commit a crime  the crime rate is affected mainly by three factors –  the available opportunities to commit crime,  the perceived risk of getting caught,  and severity of the punishment the offender believes they will receive if they are caught. According to Rational Choice Theory, the more opportunities to commit crime, the lower the risk of getting caught and the lower the likelihood of punishment, then the higher the crime rate will be.

Relative Deprivation

Lacking sufficient resources to maintain a standard of living or lifestyle which is regarded as normal or average in a given society; or lacking sufficient resources to maintain a living standard which is approved of by society. While it is possible to measure relative deprivation objectively, there is a subjective element to this concept which can make it difficult to measure – an individual can feel relatively deprived even when they are relatively well-off compared to the average, if they have an unrealistic idea about what ‘the average is’. This concept is associated with Left Realism and Jock Young’s Vertigo of Late Modernity especially.

Self-Report Studies

Surveys in which a selected cross section of the population is asked what offences they have committed. A good example of a self-report study is the ‘Youth Lifestyles Survey’ – although the last one was done over a decade ago.

Selective Law Enforcement

Where the police mainly focus on policing working class (and underclass) areas and the justice system mainly focuses on prosecuting working and underclass criminals, while ignoring the crimes of the elite and the middle classes, although both of these classes are just as likely to commit crime as the working classes. A concept associated with Marxist criminologist David Gordon.

Self-Fulfilling Prophecy

Where an individual accepts their label and the the label becomes true in practice.

Social integration

Where people are connected to society through social institutions. The more connections an individual has to social institutions, the more integrated an individual is to society. For example, someone with a job, with a family, and who spends time with others in the community is more integrated than an unemployed single loner.

Social Regulation

reaffirming the boundaries of acceptable behaviour. High levels of social regulation basically mean explicit and clear rules and norms which set out clear social expectations. In Functionalist theory an appropriate amount of social regulation is essential for preventing anomie which leads to high levels of suicide and other forms of deviant and criminal behaviour.

Socially Constructed 

Where something is the product of social processes rather than just being natural. For example, most sociologists agree that crime is socially constructed because people in society decide what crime is law breaking behaviour, and laws are made-up by people and change over time, thus crime varies from society to society. Similarly, we can say that crime statistics are socially constructed because they are the result of a series of social interactions – of people witnessing and reporting crimes and then the police recording them, rather than the stats reflecting the actual real number of crimes in any society.

Society of Saints

A phrase associated with Emile Durkheim which emphasises the inevitability and social necessity of crime. Durkheim argued that even in a ‘society of saints’ populated by perfect individuals deviance would still exist. In such a society there might be no murder or robbery, but there would still be deviance. The general standards of behaviour would be so high that the slightest slip would be regarded as a serious offence. Thus the individual who simply showed bad taste, or was merely impolite, would attract strong disapproval.

Status frustration

A concept developed by Albert Cohen in Delinquent Boys (1956) – he used it to explain working-class male delinquency as being a collective reaction against middle class success – working class boys tried hard in school and failed to gain status, got frustrated, found each other and formed a deviant subculture – status was gained within the subculture by being deviant and going against the rules of the school.

Subculture 

A group which has at least some norms and values which are different to those held in mainstream society, and can thus be regarded as deviant.

The Underclass

A term first coined by American Sociologist Charles Murray (1989) – The underclass’ refers to the long term unemployed who are effectively welfare dependent. They have higher rates of teen pregnancies and single parent households and much higher crime rates. Some statistical analysis suggests that the underclass (approximately 1% of the population) might commit as much as 50% recorded crime in the UK.

Victim Surveys

Ask people whether they have been a victim of crime, typically in the previous 12 months. The most comprehensive victim survey in England and Wales is the ‘Crime Survey of England and Wales’.

White Collar Crime

White-collar crime refers to financially motivated nonviolent crime committed by business and government professionals. Within criminology, it was first defined by sociologist Edwin Sutherland in 1939 as “a crime committed by a person of respectability and high social status in the course of his occupation”.

Zero Tolerance Policing 

Involves the police strictly enforcing every facet of law, including paying particular attention to minor activities such as littering, begging, graffiti and other forms of antisocial behaviour. It actually involves giving the police less freedom to use discretion –the police are obliged to hand out strict penalties for criminal activity.

An example of how you might go about answering such a question (not an exhaustive answer)

(Before reading this through, you might like to recap the difference between modernity and postmodernity.)

Postmodern society is a society based around consumption and consumerism rather than work – people primarily identify themselves through the goods and services they buy rather than the jobs they do. As a result there is simply more stuff being bought, which means here is more opportunity to commit crime – Robert Reiner has identified a straightforward link between the increasing amount of stuff and the increase of property crime, as witnessed with the crime explosion since the 1950s. The increase in property crime has been further fuelled by an increase in the type of ‘strain’ identified in the 1940s by Robert Merton- The mass media today is rife with programmes promoting high consumption, celebrity lifestyles as both normal and desirable, thus increasing demand for stuff, which combined with insufficient legitimate opportunities to earn enough money to buy such a lifestyle, creates what Jock Young calls a ‘Vertigo of Late Modernity’, fuelling a historically high level of property crime.

Baudrillard calls postmodern society a hyperreal society – mediated reality (basically life as experienced through the media) is more common and more ‘real’ than face to face reality – it is thus no surprise that the fastest growing type of crime is cyber-crime of many different varieties – where criminals do not come face to face with their victims – this at least partially explains one growth area of cyber crime – which is sexual and racist abuse and ‘trolling’ more generally via social-media – many such criminals would not dare say the things they do face to face. Another example of cyber crime is the online-dating romance scam, which illustrates all sorts of aspects of ‘postmodern’ crime – it is hyperreal, in that the criminals make up fake IDs to put on dating sites to lure victims into giving them money, and many of these scams are done by people in West Africa, illustrating the global nature of much postmodern crime, this particular example being at least partially fuelled by the wealth gap between the developing and the developing world. In short, the fact that we are connected via the internet globally, the relative ease of access to the internet, and the relatively low risk of getting caught, all help to explain the increase of cyber crime in the age of postmodernity.
